Please read these Terms and Conditions (“Terms”) carefully before using https://davidvaneveren.com (the “Site”), operated by David Van Everen Fine Art, LLC (“we,” “us,” or “our”). By accessing or using the Site, placing an order, or participating in any session or event we organize, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Overview
The Site offers original artwork, prints, art instruction and life drawing session organizing, and related services. Some of these offerings (e.g., in-person sessions and workshops) may be subject to additional terms provided separately at the time of registration; where there is a conflict, those specific terms control for that offering.
2. Intellectual Property
All artwork, images, photographs, text, and other content on the Site are the property of David Van Everen and/or David Van Everen Fine Art, LLC, and are protected by copyright and other intellectual property laws.
Purchasing artwork or a print does not transfer copyright. Unless expressly agreed in writing, purchasing an original piece or a print grants you ownership of that physical object only — it does not grant you the right to reproduce, distribute, publicly display, create derivative works from, or otherwise commercially exploit the image. All reproduction rights are retained by the artist.
You may not use images from the Site for commercial purposes, or reproduce them in any form, without our prior written consent.
3. Original Artwork
- Original artwork sold through the Site is one-of-a-kind. Once an original piece is sold, it is no longer available, and listings will be updated to reflect availability status.
- Colors, texture, and scale of original artwork may vary slightly from photographs shown on the Site due to lighting, screen calibration, and photographic limitations.
- Original works are sold as final.
4. Prints
- Prints are produced on demand through our print fulfillment partner, Lumaprints, in the sizes and formats listed at checkout.
- Because prints are produced to order, print orders are subject to the return policy of Lumaprints.
- Print colors may vary slightly from the original artwork and from on-screen images due to differences between digital displays and physical printing.
5. Pricing and Availability
- All prices are listed in U.S. dollars and are subject to change without notice.
- We reserve the right to limit quantities, refuse or cancel any order, and correct pricing errors, including after an order has been placed. If we cancel an order after payment has been processed, you will receive a full refund.
- Promotional pricing (including seasonal sales) is valid only during the stated promotional period.
6. Payment
We accept payment via PayPal, Apple Pay, Google Pay, Amazon Pay, and major credit cards, processed through our third-party payment providers. By placing an order, you represent that you are authorized to use the selected payment method. See our Privacy Policy for details on how payment information is handled.
7. Shipping, Returns, and Refunds
- Shipping timeframes and costs will be provided at checkout and may vary based on the size and nature of the item (original artwork vs. print).
- Original artwork is shipped with care appropriate to its value and fragility; insurance can be added upon request via orders@davidvaneveren.com.
- Original artwork sales are final.
8. Life Drawing Sessions and Workshops
Life drawing session organizing and any related workshops are offered separately from artwork sales and may involve additional registration terms, liability waivers, and cancellation policies provided at the time of signup. Participation in any in-person session or event is subject to a separate liability release, which you will be asked to review and sign before attending.
9. User Accounts
If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
10. Prohibited Uses
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Site or its underlying systems
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without our express written permission
- Interfere with or disrupt the Site’s functionality or security
11. Third-Party Links and Marketplaces
The Site may reference or link to third-party platforms, including Saatchi Art. We are not responsible for the content, policies, or practices of third-party sites. Any purchase made through a third-party marketplace is governed by that platform’s own terms, not these Terms.
12. Disclaimer of Warranties
The Site and all products are provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by applicable law.
13. Limitation of Liability
To the fullest extent permitted by law, David Van Everen Fine Art, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of any product, including but not limited to loss of data, loss of profits, or damages resulting from shipping delays or damage in transit.
14. Indemnification
You agree to indemnify and hold harmless David Van Everen Fine Art, LLC, its owners, and affiliates from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Sonoma County, California.
16. Changes to These Terms
We may revise these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
